1. Agreement to Terms

By downloading, installing, or using the Your Chapter mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Your Chapter ("Company," "we," "our," or "us").

2. Eligibility

To use the App, you must:

  • Be at least 13 years of age

  • Have the legal capacity to enter into a binding agreement

  • Not be prohibited from using the App under applicable laws

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account using:

  • Email and password, or

  • Apple Sign-In, or

  • Google Sign-In

You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activities that occur under your account

  • Notifying us immediately of any unauthorized access

We are not liable for any loss resulting from unauthorized use of your account.

3.3 One Account Per User

You may only create and maintain one account. Multiple accounts may be terminated without notice.

4. Subscription and Payments

4.1 Free and Premium Tiers

The App offers:

  • Free Tier: Limited access to features (e.g., 1 workbook per month, 2 AI recommendations per month)

  • Premium Subscription: Enhanced access to features (e.g., 15 workbooks per month, 30 AI recommendations per month)

4.2 Billing

  • Subscriptions are billed through Apple App Store or Google Play Store

  • Payment is charged to your App Store or Play Store account at confirmation of purchase

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period

4.3 Cancellation

  • You may cancel your subscription at any time through your App Store or Play Store account settings

  • Cancellation takes effect at the end of the current billing period

  • No refunds are provided for partial billing periods

4.4 Price Changes

We reserve the right to change subscription prices. You will be notified in advance of any price changes affecting your subscription.

4.5 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

5. Acceptable Use

5.1 Permitted Use

You may use the App for personal, non-commercial purposes to:

  • Track and organize your reading

  • Generate AI-powered workbooks and quizzes

  • Receive book recommendations

  • Reflect on and retain information from books you read

5.2 Prohibited Conduct

You agree NOT to:

  • Use the App for any illegal purpose

  • Attempt to gain unauthorized access to the App or its systems

  • Interfere with or disrupt the App's functionality

  • Reverse engineer, decompile, or disassemble any part of the App

  • Use automated scripts, bots, or scrapers to access the App

  • Share your account credentials with others

  • Resell, redistribute, or commercially exploit the App or its content

  • Upload malicious code or content

  • Harass, abuse, or harm others through the App

  • Circumvent any usage limits or restrictions

  • Use the App to infringe on intellectual property rights

5.3 AI-Generated Content

Content generated by our AI features (workbooks, quizzes, recommendations) is provided for educational and personal reflection purposes only. We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

6. Intellectual Property

6.1 Our Property

The App, including its design, features, code, graphics, logos, and all content provided by us, is owned by Your Chapter and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.

6.2 Your Content

You retain ownership of content you create within the App (e.g., notes, reflections). By using the App, you grant us a license to store, process, and display your content solely to provide the App's services to you.

6.3 Book Information

Book titles, covers, descriptions, and metadata displayed in the App are sourced from third-party providers (e.g., Google Books). These remain the property of their respective owners.

6.4 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use them without compensation or attribution.

7. Third-Party Services

The App integrates with third-party services including:

  • Google Books API (book information)

  • Perplexity AI (AI-powered features)

  • RevenueCat (subscription management)

  • Firebase (analytics)

  • Microsoft Clarity (session recordings)

  • PostHog (product analytics, session recordings, and feature flags)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimers

8.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Guarantee

We do not guarantee that:

  • The App will be uninterrupted, secure, or error-free

  • Results obtained from the App will be accurate or reliable

  • Any errors will be corrected

  • AI-generated content is factually accurate

8.3 Book Recommendations

Book recommendations are generated by AI based on your preferences and are not endorsements. We are not responsible for the content of any books you read based on our recommendations.

8.4 Security

While we implement reasonable security measures to protect your data, no system is completely secure. You acknowledge that:

  • Data transmission over the internet carries inherent risks

  • We cannot guarantee absolute security of your information

  • You provide personal information at your own risk

  • We are not liable for unauthorized access, hacking, data loss, or other security breaches beyond our reasonable control

  • In the event of a data breach, our liability is limited as set forth in Section 9

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM

  • WE ARE NOT LIABLE FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL

These limitations apply regardless of the legal theory and even if we were advised of the possibility of such damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Your Chapter, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Your user content

11. Account Termination

11.1 Termination by You

You may delete your account at any time through Settings > Delete Account. Upon deletion:

  • You have a 7-day grace period to cancel the deletion

  • After 7 days, your account and data are permanently deleted

  • Active subscriptions should be cancelled separately through your App Store or Play Store

11.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms

  • Engage in fraudulent or illegal activity

  • Abuse the App or its features

We may also discontinue the App at any time with reasonable notice.

11.3 Effect of Termination

Upon termination:

  • Your license to use the App ends immediately

  • We may delete your data (subject to legal retention requirements)

  • Provisions that by their nature should survive will remain in effect

12. Modifications to Terms

We may modify these Terms at any time. Changes will be effective when posted. We will notify you of material changes through:

  • In-app notifications

  • Email (if provided)

  • Updated "Last Updated" date

Your continued use of the App after changes constitutes acceptance of the modified Terms. If you disagree with changes, you must stop using the App.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

  1. Informal Resolution: Contact us first to attempt to resolve the dispute informally

  2. Mediation: If informal resolution fails, parties agree to attempt mediation

  3. Courts: If mediation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales

13.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions or class arbitrations.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

14.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

14.5 Force Majeure

We are not liable for delays or failures resulting from circumstances beyond our reasonable control.

16. Apple App Store Additional Terms

If you downloaded the App from Apple's App Store:

  • These Terms are between you and Your Chapter, not Apple

  • Apple has no obligation to provide maintenance or support

  • Apple is not responsible for any claims related to the App

  • Apple is a third-party beneficiary of these Terms

17. Google Play Store Additional Terms

If you downloaded the App from Google Play:

  • These Terms are between you and Your Chapter, not Google

  • Google has no obligation to provide maintenance or support

  • Google is not responsible for any claims related to the App
